2. Eligibility

You affirm that you are at least 18 years old and have full legal capacity to enter into binding contracts. Use of the Site, ordering, or purchase of products constitutes your agreement to comply with and be bound by these Terms.

Marbled Meatery reserves the right to update or change these Terms at any time without prior notice. Your continued use of the Site after changes are posted signifies your acceptance of the modified Terms.

4. Account Registration & Use

  • You may shop as a guest or create an account by providing accurate and updated information.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
  • You agree to notify us immediately of any unauthorized use or security breach.
  • We reserve the right to suspend or terminate your account for any breach of these Terms or improper conduct.
  • Password reset assistance can be obtained via email verification or contacting customer support.

5. Products, Pricing & Availability

  • All prices are listed in U.S. dollars and are subject to change without prior notice.
  • We strive for accuracy in product descriptions but do not warrant that descriptions are error-free.
  • Marbled Meatery reserves the right to modify product offerings, descriptions, and prices, and to refuse or cancel orders due to pricing errors or unavailability.
  • We do not offer subscriptions, memberships, or recurring orders at this time; however, the Site may include language addressing these for future implementation.

6. Orders, Shipping & Delivery

  • Marbled Meatery ships exclusively within the United States. International shipping is not available at this time.
  • You must provide accurate shipping information. We are not responsible for delivery failures or delays due to incorrect or incomplete information.
  • Perishable items require prompt acceptance at delivery. Marbled Meatery is not liable if products are left unattended or refused.
  • Orders can be canceled within 24 hours of purchase only; thereafter, orders proceed to fulfillment and cannot be canceled or changed.
  • Shipping costs and estimated delivery times are provided at checkout.

7. Returns & Refunds

  • Given the perishable nature of our products, all sales are final.
  • Please consult our separate Return Policy for procedures regarding damaged or incorrect deliveries.
  • We do not offer returns or restocking for products except as set out in the Return Policy.

8. Gift Cards

  • Marbled Meatery gift cards have no expiration date.
  • Gift card purchases are non-refundable, cannot be redeemed for cash, and are not transferable except as permitted by law.
  • Unused balances may be applied to accounts or donated to the Houston Food Bank at our discretion.

9. Intellectual Property

  • All content on the Site including logos, text, images, designs, graphics, and software are owned or licensed by Marbled Meatery LLC and are protected by intellectual property laws.
  • Unauthorized use, reproduction, or distribution of Site content is prohibited.

10. Third-Party Services & Links

  • The Site may incorporate third-party tools, APIs, and payment gateways.
  • We may provide links to partner, vendor, or social media sites for your convenience.
  • Marbled Meatery holds no responsibility or liability for these third-party services, their content, or their privacy practices.

  • Customer reviews, comments, and other content submitted by users may be displayed on the Site.
  • By submitting content, you grant Marbled Meatery a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such content throughout any media.

  • To the fullest extent permitted by law, Marbled Meatery disclaims all warranties and is not responsible for indirect, incidental, consequential, or punitive damages related to your use of the Site or products.
  • Our total liability for any claim shall not exceed the amount you paid for the particular goods or services giving rise to such claim.

15. Disclaimer of Warranties

The Site and products are provided “as is” and “as available” without warranty of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

16. Dispute Resolution & Governing Law

  • All disputes must be raised within two months from the date of purchase. Claims outside this period may be eligible for account credits or charitable donation to the Houston Food Bank, at our discretion.
  • These Terms shall be governed by and construed under the laws of the State of Texas.
  • Any disputes shall be resolved by binding arbitration held in Texas, except where otherwise prohibited by law.

17. Communications & Marketing

  • By providing your phone number and opting in, you consent to receive SMS notifications including marketing materials.
  • You may opt out of marketing messages at any time; however, transactional and account-related communications are mandatory.
  • Marketing emails include clear opt-out instructions.
